Copyright, Image Usage Policy and Terms of Use

1. Ownership and Copyright

1.1 All photographs, images, videos, captions, text, graphics and other content on this website (the "Work") are the original creations of Suzanne Wheatley ("I", "me", "my") and are protected by copyright under the Copyright, Designs and Patents Act 1988 and international copyright treaties.

1.3 I assert my moral rights, including my right to be identified as the author of the Work and my right to object to derogatory treatment of it, under sections 77 and 80 of the Copyright, Designs and Patents Act 1988.

1.4 Viewing, sharing a link to, or purchasing a print or digital file does not transfer copyright or any other intellectual property right to you. Unless a written license or assignment signed by me says otherwise, all rights remain with me.

2. What You May Not Do Without My Written Permission

You must not, without a written license from me:

• copy, download, screenshot, scan, reproduce, crop or edit any image;

• publish, post, upload or share any image online (including on social media, blogs, marketplaces, forums or websites), in print, on television or in any other medium;

• use any image commercially, including in advertising, marketing, packaging, merchandise, editorial or promotional material;

• remove, alter or obscure any watermark, copyright notice, credit, metadata or other rights management information;

• hotlink to or embed images directly from this website;

• sell, sub-license, lend, hire out or distribute any image;

• use any image to create derivative works, including composites, edits, filters, illustrations or AI-generated or AI-altered versions;

• use any part of the Work to train, fine-tune, test or improve any artificial intelligence or machine learning model, or to scrape or mine text or data from this website. I expressly reserve all rights in this respect, including the right to opt out of text and data mining.

3. Permitted Use

3.1 You may view the Work on this website for your own personal, non-commercial enjoyment.

3.2 Sharing links. You may share a link to a page on this website.

3.3 Social media sharing. You may share images using the share buttons on this website, or reshare my own posts using the platform's built-in share function, provided the image is not cropped, edited or altered, and the credit "Photo: Suzanne Wheatley" and a link to www.suzyredphotography.com remain visible.

3.4 Press and reviews. Journalists and bloggers may contact me for permission to use images to review or report on my work. Permission is not automatic.

Any use not expressly permitted in this section requires a license.

4. Licensing: How to Request Permission

4.1 To use any image, you must contact me before you use it, at:

4.2 Please include:

• your name and organisation;

• the image(s) concerned (a link or filename);

• the intended use (for example, website, print, advertising, editorial, social media, packaging);

• the medium and territory (for example, UK only, worldwide);

• the duration of use;

• print run, circulation or audience size, where relevant.

4.3 Fees depend on the image, usage, medium, duration, territory and exclusivity. I will send you a quote and license terms. No license exists until the terms are agreed and confirmed in writing by me, and any license fee has been paid.

4.4 Unless otherwise agreed in writing, every license is:

• non-exclusive;

• non-transferable and non-sub-licensable;

• limited to the specific use, medium, territory and period stated;

• conditional on the credit line I specify;

• conditional on payment in full. Until payment is received, you have no right to use the image.

4.5 Any use beyond the agreed scope needs a new license.

5. Credit

Where a license or permission requires credit, it must appear next to the image, or as otherwise agreed in the license, in this form: Photo: Suzanne Wheatley (or Suzy Red Photography). Credit does not replace the need for a license.

6. Commissioned and Client Work

6.1 For commissioned work, my agreed contract or booking terms govern ownership and usage. If there is no signed agreement to the contrary, I retain copyright in all images I create, and the client receives a license for the uses agreed in the booking.

6.2 Unless agreed otherwise, I may use images from commissioned work in my portfolio, website, social media, competitions, print promotion and for self-promotion. If you would prefer certain images are not used, please tell me in writing before the shoot or delivery.

6.3 Delivered images may not be passed to third parties (such as other businesses or agencies) for use beyond the agreed license without my consent.

7. Models, People, Property and Third-Party Rights

7.1 Where an image features identifiable people, private property, trademarks, artwork or other third-party material, a license from me covers only my copyright. It does not include any permission from people or owners shown.

7.2 It is your responsibility to make sure you have any additional clearances needed for your intended use.

7.3 Images may not be used in a way that is defamatory, unlawful, misleading, pornographic, discriminatory, or that suggests the people shown endorse a product, service or opinion.

8. Unauthorised Use

8.1 If you use my Work without a license, I may take action to protect my rights. That may include requesting immediate removal, issuing takedown notices to website hosts, platforms and search engines, and pursuing remedies available under UK or international law.

8.2 These remedies can include claims for damages (including a license fee I would reasonably have charged for the use made), an account of profits, injunctions, and recovery of legal costs.

8.3 Knowingly removing or altering copyright management information or watermarks may be a separate infringement.

8.4 If you believe you have used an image by mistake, please contact me promptly. Prompt removal and honest co-operation will be taken into account.

9. Website Use and Disclaimers

9.1 This website and its content are provided "as is". I try to keep information accurate and up to date but make no guarantees about its completeness or availability.

9.2 I am not responsible for the content of external websites I link to.

9.3 Nothing in these terms excludes or limits liability that cannot be excluded or limited by law.

9.4 Prices, availability and descriptions of prints, products or services may change without notice.

10. Privacy

If you contact me or use forms on this website, I will handle your personal data in accordance with my Privacy Policy [available on request], in line with UK GDPR and the Data Protection Act 2018.

11. Changes to These Terms

I may update this policy from time to time. The version on this website on the date you use it applies. The "last updated" date at the top shows when it last changed. Licences already agreed in writing remain subject to their own terms.

12. Governing Law

These terms and any dispute connected with them are governed by the laws of England and Wales, and the courts of that jurisdiction have exclusive jurisdiction, except that you may have additional rights as a consumer where you live.
